Grounds and purposes for which we use your personal data

We process your personal data on the following grounds:

  • The Terms and Conditions for use of the Website;
  • Your explicit consent – the purpose is specified in each individual case;
  • Where an obligation is imposed by law.

In the following paragraphs you will find detailed information on the processing of your personal data according to the ground on which we process it.

3

Enquiries and viewings

When you send us an enquiry through the forms on the Website, by phone or by email, we process your data in order to take steps at your request before a possible contract.

Data we process: name, phone number, email address, preferred contact method, message and the property you are interested in.

Purposes of processing:

  • answering your enquiry and providing information about properties;
  • arranging a viewing;
  • preparing a preliminary contract if you decide to proceed.

We delete data collected on this ground 2 years after our last contact with you, unless a contract is concluded between us, in which case we keep it for the periods required by law.

4

We process your personal data on this ground only after your explicit, unambiguous and freely given consent. We will not impose any adverse consequences on you if you refuse the processing of your personal data.

Consent is a separate ground for processing your personal data; the purpose of the processing is stated in the consent itself and does not overlap with the purposes listed in this policy. If you give us the relevant consent, then until it is withdrawn or until any contractual relationship with you ends, we prepare offers of products/services suited to you by carrying out detailed analyses of your basic personal data.

On this ground we may process personal data for the purposes of direct marketing, including data on your use of the website and data on social media profiles.

Disclosure of data to third parties

On this ground we may disclose your data to marketing agencies, Facebook, Google or similar parties.

Consents given may be withdrawn at any time. Withdrawal of consent has no effect on the performance of contractual obligations. If you withdraw your consent to the processing of personal data for any or all of the methods described above, we will not use your personal data and information for the purposes specified above. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

You can withdraw your consent at any time by emailing sales@newtower.bg or, for cookies, through the cookie settings on the Website.

When we erase data collected on this ground

We delete data collected on this ground at your request or 12 months after it was first collected.

Users' rights

Every User of the website enjoys all personal data protection rights under Bulgarian law and the law of the European Union.

The User may exercise their rights by sending a message to our email address.

Every User has the right to:

  • Information (regarding the processing of their personal data by the controller);
  • Access to their own personal data;
  • Rectification (if the data is inaccurate);
  • Erasure of personal data (the "right to be forgotten");
  • Restriction of processing by the controller or the processor of personal data;
  • Portability of personal data between controllers;
  • Object to the processing of their personal data;
  • The data subject also has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them;
  • Judicial or administrative protection where the rights of the data subject have been infringed.

Right to erasure

The User may request erasure where one of the following conditions applies:

  • The personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
  • The User withdraws the consent on which the processing is based and there is no other legal ground for the processing;
  • The User objects to the processing and there are no overriding legitimate grounds for the processing;
  • The personal data has been processed unlawfully;
  • The personal data must be erased to comply with a legal obligation under Union or Member State law to which the controller is subject;
  • The personal data has been collected in relation to the offer of information society services to children and consent was given by the holder of parental responsibility over the child.

Right to restriction

The User has the right to restrict the processing of their personal data by the controller where:

  • They contest the accuracy of the personal data. In this case, the processing is restricted for a period enabling the controller to verify the accuracy of the personal data;
  • The processing is unlawful, but the User opposes the erasure of the personal data and requests the restriction of its use instead;
  • The controller no longer needs the personal data for the purposes of the processing, but the User requires it for the establishment, exercise or defence of legal claims;
  • They have objected to the processing pending verification of whether the legitimate grounds of the controller override the interests of the User.

Right to portability

The data subject has the right to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used and machine-readable format, and has the right to transmit that data to another controller without hindrance from the controller to which the personal data has been provided, where the processing is based on consent or on a contractual obligation and the processing is carried out by automated means. In exercising their right to data portability, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible.

Right to object

Users have the right to object to the controller to the processing of their personal data. The personal data controller must stop the processing unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims. Where the processing of personal data for direct marketing purposes is objected to, the processing must stop immediately.

7

Complaint to the supervisory authority

Every User has the right to lodge a complaint about the unlawful processing of their personal data with the Commission for Personal Data Protection (Комисия за защита на личните данни) or with the competent court.
